An Overview of a Prenup and Postnup

While you may feel you are in love and your relationship will never end, it is important to at least consider the possibility that it could someday end. Currently, 44% of all first marriages end in divorce and the rate of divorce increases to 67% or higher for second marriages.

What is a Prenup?
A prenuptial agreement is made prior to marriage. The couple will determine how to divide assets in the event of divorce. If it is a second marriage, it is common to see couples engage in prenups as they are a measure of protection. A prenup is designed to prevent a drawn-out divorce that turns highly emotional. A prenup also assists in the event of a death as it clearly lays out financial distributions and children’s needs.
What is a Postnup?
A postnuptial agreement are similar to a prenup, but they are made after the couple has been married. It is important to understand that once you are married, all assets become joint, so you will need to be clear on how you wish these assets to be divided in the agreement.
We recommend speaking with our attorneys to determine the best option for your needs. We can help you review multiple scenarios, and determine the best option to protect your assets and finances as well as your children.
