What is a Guardian and Conservator?
A guardian is someone who the court appoints to make decisions pertaining to the care of another person (often called a ward). A conservator is appointed by the court to manage financial affairs and property.
A petition must be filed with the court to establish guardianship or conservatorship. Notice must be provided to all persons of interest in the case, your spouse and children. Attorneys are used to represent the children (ward) during legal proceedings when a guardian is appointed.

Mental Health Guardianship
Guardianship is often used for individuals who are impaired with mental illness or mental deficiency. There are other circumstances in which a guardian is appointed including:
- Physical illnesses or disabilities
- Chronic drug or alcohol use
- Inability to communicate responsible decisions
Guardians are often used in cases when an individual is unable to attend to their basic needs such as obtaining food, shelter, clothing, and medical needs.
Conservatorship
Conservators can be family members, a professional or a trusted company. Their job is to use skill and care to protect and manage the investment of the assets of the ward. The court must find that the ward has assets of income that could be wasted without the appointment of a conservator.
